Nobody could have imagined that a widow’s pour over will and trust, that provided for an equal division between two surviving sons, would ignite a 10-year battle fueled by allegations of secret undue influence and self-dealing by one brother that required an extensive series of subpoenas and document production before it was uncovered.

But, that’s exactly what happened in a case that was recently resolved with the help of Lipson Neilson Attorney Steven Malach. In the end, the case was satisfactorily resolved with the contesting brother receiving what he was entitled to according to is late mother’s wishes.

Steven Malach heads the Lipson Neilson law firm’s estate planning practice group and the Center For Estate Planning.
