Lipson Neilson Successfully Defends Real Estate Agent and Three Brokers in $1.4M Arizona Lawsuit Involving a Real Estate Transaction Gone Bad

In a recently decided lawsuit, Steven Malach led a team of Lipson Neilson attorneys that successfully defended an Arizona real estate agent and three real estate brokers against a six-count complaint alleging tort and contract claims. The plaintiffs alleged that the agent and brokers were responsible for $1.4 million worth of damage caused by extensive mold in a home.

This lawsuit took four years and included a two-week trial by Zoom with testimony from ten witnesses and two experts who were in Arizona, Costa Rica, and Hawaii. In the end, the Judge ruled that comparative negligence barred any recovery by the plaintiff.
